This is the fourth post in my series arc of More Confessions From an Educated Fool. This one deals with the “cares of this world,” and how I got caught in a web of them, over and over again, like I was prey for a spider to bite and suck the life out of me.


So, a university president, a corporate senior vice president, and nonprofit senior program officer are all sitting at a bar off East 59th Street, after a long decision-day Thursday. Gus, their bartender, asks in his Hollywood-exaggerated New Yorker accent, “Hey jerks, what is it that youse do for a living, anyway?

Damon, the university president says, “I kneel and grovel for money.”

Steve, the senior program officer says, “I do cartwheels, somersaults, and floor exercises for money.”

After a brief pause, Alan, the senior VP says, “I use ads spots to hold up people for money,” while gesturing with his right hand in his blazer pocket. “Now give me your wallets!,” he says. The other two stooges laugh without restraint.

Gus pulls out his Saturday night special, and points it at the senior VP. “You mean like this?”

The senior VP says, without batting an eyelash or turning away, “I work for a trillion-dollar company. We get a billion people to sign their lives away every day. Hell yeah, it’s like this!”

The other stooges and Gus laugh. Damon pounds the table with his fist so hard he knocks over his drink.

After putting away his gun, Gus says, “What’ll it be? This one’s on me!”

Without taking a beat, all three gents say, “A vodka tonic.”

I have walked three paths in my career. Academia, the nonprofit world, and writing and publishing (and self-publishing) articles and books. Academia will claim that it isn’t a capitalist endeavor. The nonprofit world will say it claims 501(c)(3) tax status because they are changing the world by doing good works. The corporate world deflects while fully engaged in public displays of affection with capitalism, lips and tongues and spit included. “That’s just the way it is,” they sigh before another round of groping.

All of them are liars, I have found with 30 years (mostly) in and (sometimes) out of academia, 11 years working and consulting with nonprofits, and 20 years of off-and-on work in publishing articles and beating my brains into mush in book publishing. But if they are all liars, the lies are for people who are looking to do good in the world, for disdainful people, but people not so cynical that they have given up their core principles and universal moral values. They are for people like me.

That’s what capitalists do. They take advantage of people and rob them of their wealth, of their minds and bodies and souls. They like to do this at gunpoint, but they love to do it with slogans and pitches. “Connecting People, Creating Change” was the mantra of one Academy for Educational Development (AED), a nonprofit I worked with for nearly eight years. I used to joke that their real slogan was “Corrupting People, Creating Chaos.” The sad part was how correct I was in my assessment. This was even before I took on budgetary duties for a multimillion-dollar grant on a K-16 education project, where I learned AED had us mid- and senior-level program officer types to keep three separate budgets: one for the government, one for funders and potential funders (to hide our overhead), and the real one for AED’s nabobs. That last one included a one-percent vig on all grants that any of us brought in, a “rainy day fund” meant only for AED’s most senior staff.

It turned AED into a $600-million-a-year Ponzi scheme, and included millions in bribes to corrupt Afghans as part of the cost of “Connecting People, Creating Change” in Afghanistan and Pakistan. The truth was, the 501(c)(3) status was only to get away with making a profit off government and private foundation funding without having to pay a cent in corporate income taxes. I knew this was the reality of this world in 1999, when I made the switch to full-time nonprofit work with Presidential Classroom, when my former APUSH teacher Harold Meltzer laughed at the idea of nonprofits in the US’ capitalist regime. I had ideals about doing good outside of higher education, but I was never naive about their larger money-making agenda.

Publishers, agents, and editors would have me believe that the only criteria for publishing my stuff is if my fastball, curveball, and slider/sinker combination is good enough for dissemination. But first always comes the disclaimer: “if you have a work that doesn’t easily fit into a formulaic category, or if you are Black and over 40, or if you don’t account for the feelings of fragile white readers, we can’t make money, so we can’t publish you.” However, “we will publish schlock, how-to guides, and very famous people with ghostwriters, because that’s easy work for quick bucks.” They are the most honest liars, mostly because they don’t give a shit about the greater good. I can work with this.

But what I can no longer stomach is academia’s hypocrisy. This time 30 years ago was my first week as an MA student in the Department of History at the University of Pittsburgh. Eric, a fourth-year grad student and PhD candidate in the program, a man who once saw himself as my mentor (I never saw him that way), explained the nature of academia this way. “The academy is a medieval institution, whose ways are founded on the idea of the guild.” In my head, I’m thinking, This is utter bullshit. The European university began its missions during the 12th, 13th, and 14th centuries to be sure. But they needed funds to run then, and they damn sure do now. This analysis from an avowed 40-something Marxist let me know just how much he didn’t get about the academic world.

The only thing medieval about academia in my three decades of learning, teaching, and experiencing it is its ideals. In reality, academia is a money-making machine for its boards, for its athletics programs, and for the “hot stuff,” scientific and technological research. It serves at the will of deep pocketed robber barons, professional athletic corporations, and at the behest of corrupt governments and the military-industrial complex. That anyone comes out of a college or graduate or professional school with their sense of morality and social justice intact is no small miracle. That anyone these days earns their degrees with low debt or no debt at all is either part of the super-rich class or has performed a feat John the Baptist would be proud of. And in that latter-day case, they probably are completely fine with the system the way it is, supporting the bloated salaries of upper university managers everywhere.

The story about the three stooges of my career should end with them all stumbling drunk out of the bar, only to be robbed by some random guy wearing a ski mask. After all, that is what they deserve. What I deserve, well, that’s a bit more complicated. Loving money has a way of making the mediocre hireable, popular, and powerful, while marginalizing everything and everyone else. I spent so many years chasing promotions for funds to help pay down student loan debt and to provide for our son the life I never had growing up with poverty (and then welfare poverty in my teens). The strategy didn’t work.

I had to accept that I am not built to be a capitalist cog or hamster. I had to accept that I as a person ask questions, and make good trouble doing so. I am at my best as a writer and thinker. I am at my best when I question the worlds I have inhabited, not when I am just going along to get along in them.

In late-October 1994, I had a wonderful steak dinner with my friend and former high school classmate Laurell in DC. It was during my first ABD (all-but-dissertation) visit to the area to conduct some official initial research on my multiculturalism-in-Black-Washington, DC-doctoral thesis. It was also a couple of weeks before the midterm elections, the cycle that would sweep in Newt Gingrich as Speaker of the House and the rest of his cronies as part of the Contract With (really, on) America, the gift that has kept on giving for the past twenty-three years.

As part of our three-and-a-half hour dinner and dessert, we talked about the Clintons, their failed attempt at universal healthcare, the Contract With America, and the ongoing politics of racial resentment. Laurell said, not for the first or last time, that she was “apolitical,” that she didn’t “adhere” to “either party’s platform.” This was because she was “fiscally conservative” and “socially liberal.”

Even in ’94, I could’ve picked apart Laurell’s hair-splitting with a hot hair comb. But here’s the part that got me then and really irks me now. Being apolitical is a political stance and perspective. Being apolitical is like being agnostic. You may not believe in someone or something exactly the way most people in the crowd do. You may have some serious doubts. But you are still a human being. And since you are human, and have beliefs, you also have a political point of view. Otherwise, your apolitical stance is the equivalent of selling bullshit to others and lying to yourself.

A few weeks ago, I watched BBC World News and saw a young White actress on the telly promoting her new summer film, declaring it “apolitical” as it delved into serious issues around feminism and potentially other -isms. Here’s a news flash, folks. Every movie, piece of art, song, poem, every article, book, or TV show, contains a hidden agenda, a specific set of beliefs, an ideology. By definition, every piece of entertainment or art has a political message, no matter how gentle or subtle. Even if a movie like, say, Rough Night is just about women “laughing at themselves” and “having a good time,” the idea that White women have the right to both feminism and femininity is embedded in these otherwise rather banal phrases. And that’s a political statement, whether people are willing to see it or not.

But the realm of politics goes well beyond the world of entertainment and leisure. Politics is everywhere, in everything, and with everyone, all the time. Calling yourself “apolitical” doesn’t change this truth. If you eat steak and potatoes, you obviously aren’t a vegan, and that reflects your personal politics around food. When you buy clothes, wear perfume or cologne, take a vacation overseas, call a young person in your neighborhood an “all-American boy” or “all-American girl,” you are unwittingly expressing your politics. Even in declaring yourself a Christian, atheist, Muslim, Buddhist, or Jew, this isn’t just an admission of your love for God, Yahweh, Allah, or a lack of belief in a higher power at all. It is a worldview with political implications, one that colors how you see the world, humanity, and governance. We are all political animals, no matter how little some of us pay attention to the machinations of the Democrats and Republicans.

This is also why the common refrain among racist sports junkies about not combining sports and politics is also total bullshit. Of course the political implications of sport are intertwined with the actual sport in question! How else can you explain the blackballing of former 49er quarterback Colin Kaepernick for his Black Lives Matter kneel-downs during the National Anthem at NFL games in 2016? It’s certainly not based on Kaep’s performance or merely about a kneel-down. The politics of American racism, of faux-hyper-patriotism, of money and fandom, were and remain in play here. That some continue to doubt this is yet another example of the penchant of millions to crave willful ignorance of anything that would make them think beyond their own perceived superiority and simplistic views of an always political world.

So no, you can’t away from politics in this world. One would have to take a time machine back to before the Agricultural Revolution to find humans in a world without politics. But even then, there would be domestic politics, gender politics, tribal politics, and food/water politics. Not to mention, religion and the politics thereof. But, keep believing that you’re apolitical, and see how that works out as your worldview comes crashing down.

Since the allegedly sexually harassing, racism and classism denying, Republican presidential candidate leader of the moment Herman Cain likes to sing, I decided to make a short list of Cain’s greatest hits. Trust me, they’re all doozies. They draw on the experiences of a man about as in touch with average Americans as Marie Antoinette was with French peasants on the eve of the French Revolution.

1. “The Way It Is” (1986) — Bruce Hornsby and The Range: Here, he puts special emphasis on the line, “Just for fun he says, ‘Get a job!,” not out of sarcasm, but out of sincerity.

2. “Another Day In Paradise” (1989) — Phil Collins: Cain tries to get a bit of social consciousness, at least, in emphathizing with “the man on the street,” the poor guy subjected to a worn-out homeless women begging for help.

She calls out to the man on the street
“Sir, can you help me?
It’s cold and I’ve nowhere to sleep
Is there somewhere you can tell me?”

He walks on, doesn’t look back
He pretends he can’t hear her
He starts to whistle as he crosses the street
She’s embarrassed to be there

The real test with this song would be whether Cain’s whistling is as good as his crooning.

3. “O.P.P.” (1991) — Naughty By Nature: Here Cain would need help from ex-RNC head Michael Steele to get his rap game together, as well as from Supreme Court Justice Clarence Thomas in interpreting the sexual laden lyrics. But in light of the accusations — and in Justice Thomas’ case, evidence — of sexual harassment and general insensitivity of Cain, Steele and Thomas, figuring out “who’s down with O.P.P.?” is an appropriate question in their bubble.

4. “Cigarettes And Coffee” (1966) — Otis Redding: Cain’s tribute to his campaign manager in his recent commercial as he slows down the pace a bit. “And please, darling, help me smoke this one more cigarette,” Cain baritones to Mark Block.

5. “Ain’t That A Kick In The Head” (1960) — Dean Martin: Cain’s theme song for his campaign. The main lyrical refrain for him would be as much about his rise to the top of the Republican heap as it would be about the people he’s stereotyped, vilified, denigrated and ultimately exploited over the course of his career and campaign.

My head keeps spinning;
I go to sleep and keep grinning;
If this is just the beginning,
My life’s gonna be beautiful.
I’ve sun- shine enough to spread;
It’s like the fella said…

“Ain’t [I] like a kick in the head?” And the 99 percent of us say, “Hell, yeah, where’s the aspirin?”

In the past couple of years, in my down time between teaching and occasional consulting, I sometimes listen to ESPN 980 Washington, DC. I get a perverse pleasure out of it, especially this time of the year. With football season on, there’s nothing better than hearing Washington Redskins (hereafter known in this blog as Deadskins) fans whine and complain and kvetch after a loss. It’s not just because I became a New York Giants fan when I was a teenager. Nor is it because I’m also a Pittsburgh Steelers fan. No, there’s something different about these Deadskins fans, something that might be related to the personality of this area.

To those who don’t read my blog regularly, I’ve only been a DC/Maryland resident consistently since August ’99 (I did live in DC briefly in ’95 while doing my doctoral thesis research). I grew up in Mount Vernon, New York — the greater NYC metropolitan area, not upstate, just in case — for the first seventeen years and eight months of my life. I went to school and lived and taught in Pittsburgh for twelve other years. Not to mention spent the equivalent of five weeks in the Bay Area, three weeks in Atlanta, and two weeks apiece in Chicago and Boston. From a sports perspective, none of these areas and cities have fans as delusional as Deadskins fans, at least, not on a game-by-game or week-to-week basis.

The best way to show the difference is to take the same scenario and apply it to each city or area in which I’ve lived. The hometown team has just lost a game, in the ugliest possible way. Tune into a sports talk show or read the headlines for each team in their respective cities/areas, and this is what you’d read or see:

After a Giants loss:

“They suck! They suck! Did you see what Eli did with that throw! I’m tired of these guys screwin’ up! I want Coughlin’s head on a f–ing pike!”

That would go on for a day, maybe two, and if it’s really bad, maybe for three or four days. Then eventually, the Giants fan base settles down to, “What do we have to do to win this week?”

After a Steelers loss:

“My God, man, what happened out there today? Maybe we’re gettin’ too old, maybe Ben’s still playin’ hurt. You know, maybe this just ain’t our year.”

This would go on for a couple of days. Then, like the little engine building up momentum, the Stiller’s talk would turn to, “What do we have to do to win this week?”

After a Deadskins loss:

And this goes on all week long, every week they lose, and through every off-season. Until talk show hosts like the great former Georgetown coach John Thompson literally cuts callers off due to their “high levels of ignorance.”

It’s not as if the other places I’ve lived and the teams I’ve rooted for haven’t seen any hardship. Heck, the Steelers went through a twelve-year decline between their fourth Super Bowl win in ’80 and the hiring of Bill Cowher in January ’92, the last five seasons I witnessed first-hand. Not a single fan jumped off a bridge because of a loss, or took a rocket up to the moon over a victory. Maybe the realism that Pittsburgh as a city had to live with, including the loss of their industrial base for jobs, had something to do with their realism around the Steelers.

As a Giants fan, I appreciated their realism, and it helped make me a Stillers fan, too. Coming from an area where my team had one their first Super Bowl in ’87, only three years removed from a 3-12-1 season in ’83, I thought that some Johnny-Come-Lately types expected too much in a strike/scab-shortened season. But, even with that, the cycle of Jackie Gleason-esque fits of rage, followed by calm rationalism, were a reflection of the New York City I knew in the ’80s, sometimes ugly, but usually manageable. Even in troubled times.

This cycle also made the Giants fans of the ’80s more psychologically stable than the average Deadskins fan, then and now. Yes, it’s a reflection of an area of the nation that is also out of touch, as the worst effects of the Great Recession aren’t equally felt. As the expectations of Deadskins fans are as realistic as it was to believe that Mayor Vincent Gray could move DC government in the same way as Adrian Fenty, only without the ruffled feathers.

This form of delusion, though, otherwise known as bipolar disorder, where the highs are euphoric and lows can make you suicidal, may be catching on. For it shows our expectations of the economy and our politics.

A Friendship Changing Lanes

Part of the problem of being me is the fact that my close friends change as I change. Meaning that there have been transitional periods throughout my life that my old friends fall away. Oftentimes I make new ones, and sometimes, like during my six years in Humanities, my best friend was my imagination. Ironically, the best friendship I had from my Humanities days came with a classmate that I hadn’t become close to until my last couple of years at Mount Vernon High School. More ironically, that friendship didn’t truly become such until we both went away for college in ’87.

I’ve written about her before, the valedictorian of my class, whom I called “V” in a previous post (see Valedictorian Blues from July ’09). To be honest, I’m not sure how our acquaintanceship ever became a friendship. Somewhere between having circumstances in which our fathers weren’t around consistently, or at least being able to relate to Billy Joel, or both of us scoring “5”s on the AP US History exam.

But really, it might’ve just come down to both of us not belonging, or facing a small degree of ostracism from our Humanities and MVHS classmates overall. I wasn’t Black and cool enough, and V, well, she was a classic White nerd, a grinder who had the gall to finish ahead of our Black male salutatorian, at least from the perspective of some authority figures and the school’s popular crowd.

The fact that we went our respective ways, to Pitt and Johns Hopkins, helped. The fact that we wrote each other about some of our social triumphs and challenges helped more. Most importantly, it helped a lot that we both were more honest about our family troubles. Everything from my mother’s need to divorce my idiot stepfather and the issues with my younger siblings to V’s mother and her health issues and struggling with burnout trying to watch over her family while going to school.

So, by the time I began my second year of grad school, we’d become fairly close. I visited her and her family in the DC area eight times during the ’90s, and went to her mother’s funeral and wake in ’96. V came to my PhD graduation ceremony the following year. By ’97, me and V had been friends for ten years, and known each other more than fifteen. For more than six years, she’d really been the only person from my Humanities and high school days with whom I’d been in regular contact.

Who knew that within four years of marching for my doctorate that our friendship would become a distant one? I think that our approaches to life was so different that we couldn’t help but become distant friends. I am one who refuses to take life on its own terms. If I had taken V’s approach, I’d still be living in Mount Vernon, New York, only with a nine-dollar-an-hour job sorting mail or flipping carcinogenic burgers. V’s was based on some sort of realism that mixed with a sense of eugenic inevitability. That one’s slot in life should remain such, and if one does make it, one must do so without ruffling any feathers.

Besides that, it was obvious that things about who we had been since the early ’80s had evolved, and was changing even more rapidly as we reached our late twenties. I was no longer the blank-faced, closed-mouthed, socially-awkward kid I was in ’82. V was no longer responsible for watching over her mother and her younger sister. We agreed to disagree on so many things. Our politics diverged. Our views on race and racism were growing further apart, as if I was Michael Eric Dyson and she was Ann Coulter.

But even with all of that, I think the seeds of it began when I started dating my future wife at the end of ’95. Something about being in a serious relationship has changed the dynamics of every friendship I had then and have now. I never thought that my friendship with V would be affected. But of course it was. We live in a world where a man and a woman can’t be close friends without it being made into something more than friendship.

Like the seasons, people change, and even if they change for the better, our change will cause our friendships to change as well. It’s just too bad that V couldn’t adapt to all of the good changes in my life like I adapted to hers.

Generation Gap

Off and on for three years, I’ve waled on the ’60s generation and its own obsession with its achievements. Not to mention its occasional turn to Generation Xers and those younger than us, as if to say, “Well, why aren’t you more like us?” For years I thought that this was the stuff of arrogance, a sense of superiority that the Baby Boom Generation felt toward us young folk. But I’ve come to the realization that it’s just the opposite, that the folks who marched with Dr. King and shut down Berkeley and Columbia were themselves attempting to fill shoes larger than Shaquille O’Neal’s size twenty-threes. And no, this isn’t about my generation.

For the umpteenth time, I watched most of the Band of Brothers series on Memorial Day (it was on Spike TV, of all places). If it’s possible for me to have a man-crush on anyone, it’s with Damien Lewis playing Col. Richard Winters, as well as the man himself. So moving, so inspirational, and so hard to live up to. Especially since another 16 million men and women served in the armed forces during the Second World War. Millions more worked hard in factories and on farms, in shipyards and railroad yards to supply these folks with food, equipment and ammunition to fight.

The generation of folks born between 1910 and 1930 are part of what Tom Brokaw and others have called the “Greatest Generation.” That’s going a bit too far, given that the generation born in the 1880s and 1890s helped make them this way. But given the times they grew up in — the Roaring ’20s, the Great Depression, and the Second World War — it’s hardly a stretch to say that as a generation, they rose far  above their circumstances to achieve great things, to build and rebuild our country, to make the US as great as it would become after the war.

Sure, there are a variety of tensions in this assessment, racial segregation and discrimination not being the least of these tensions. In this case, then, you could argue that the generation of Blacks born between 1915 and 1930 were the “Greatest Generation.” They’re the ones who marched on Washington in ’63, who helped do the leg work for Brown v. Board of Education, who fought segregation and discrimination to fight valiantly in World War II, where leaders like Dr. King, Malcolm X, and so many others emerged. To act as though Whites from this generation weren’t themselves fighting against racial segregation, economic inequality, and gender discrimination is to deny the tensions that existed in the world in which Baby Boomers grew up in, the mythically placid ’50s and early ’60s.

So yes, the ’60s generation was one that was radicalized by civil rights, Vietnam, social unrest, politics (and eventually, a distrust for government), it was also one that, for all its denial, was following in the footsteps of the generation before. It would be nice if folks from this generation would put their narcissistic biases aside and give a fair and complete assessment of their own achievements and their own role in creating the narcissistic generations that have followed in their footsteps. But they’re probably not going to do that. Oh well.

I love Michael Wilbon’s work as a sports journalist, columnist with The Washington Post, as a commentator on the NBA on ESPN/ABC, and as co-host of Pardon the Interruption (PTI) on ESPN with Tony Kornheiser. I’ve loved his work for a bit more than two decades, certainly in comparison to Pope Lupica and the other holier-than-thou sports reporters and columnists out there these days. I find him refreshing as a journalist and writer, and an unabashed and unafraid host when it comes to how sports and American society intersect.

But I found myself bitterly disappointed in Wilbon’s “can’t legislate morality” comment on PTI on Wednesday, April 21. Wilbon said this in response to the NFL’s six-game suspension of two-time-Super Bowl-winning-quarterback and Pittsburgh Steeler Ben Roethlisberger for the latter’s violation of the league’s personal conduct policy. The NFL “shouldn’t legislate morality,” Wilbon said, as Roethlisberger “hadn’t committed a crime.” NFL Commissioner Roger Goodell, the league, and the Steelers ownership were all “overreacting,” according to Wilbon. Well, Wilbon has certainly earned the right to be entitled to his opinion. But, as my wife has said to me on countless occasions, Wilbon’s also entitled to be wrong.

Societies, governments, employers and families “legislate morality” every single day, and have been doing so for as long as there has been a human civilization on this planet. Murder, stealing, banking regulations, adultery, and certainly sexual assault and rape are all examples of us “legislating morality” over the past five millenia. Now, I’m not totally naive — I know what Wilbon was attempting to say (I think). That because Roethlisberger wasn’t arrested, indicted or convicted, that the issue of his alleged encounter with a twenty-year-old White college student whom he helped become incredibly intoxicated is now a moral one, not a criminal one. Yes, this is true. But what would ESPN do to someone like Wilbon in the same situation? What would the University of Maryland system do to me in that situation? Would ESPN let Wilbon continue to show up for work without a reprimand, a suspension, or a quiet termination? Would I continue to teach classes, or would my employer consider not renewing my teaching contract?

We as a people legislate morality in ways that none of us really think about. Like Wilbon, most of us think that crimes are crimes and morals are morals, as if passed down from Moses or Hammurabi completely unchanged for the past 3,800 years. But moral issues have led to things that once were not crimes becoming crimes. The whole notion of illegal drugs or illegal immigrants didn’t exist in this country a century ago. Someone could’ve been a pot-smoking Polish immigrant “without papers” in 1910, and that immigrant wouldn’t have gone to jail. The folks in favor of making marijuana illegal or shutting off immigration from Southern and Eastern Europe didn’t end their crusades (however misguided) by saying, “Well, we can’t legislate morality!”

Or, to use much more recent examples, those White supremacists who said, “you can’t legislate morality” after the Brown v. Board of Education decision, the passage of the Civil Rights Act of 1964 and the Voting Rights Act of 1965. For nearly twenty years, those opposed to Black civil rights argued that the issue of Black equality was a moral issue, not a legal or human rights one. Or those from the Religious Right who said, “you can’t legislate morality” when the Supreme Court’s Roe v. Wade decision came down in 1973 or in the wake of the growing Gay Rights Movement in the late-1970s. Of course, in both cases, those in leadership who were influenced by what we now call the evangelical movement have engaged in legislating morality since the early ’90s, attempting to roll back Roe v. Wade and putting laws on books defining marriage as only between a heterosexual adult male and a heterosexual adult female.

On the issue of civil rights, desegregation, reproductive rights and gay rights, what is and isn’t moral isn’t just a matter of perspective. It’s also a matter of power and bias and the people who are wielding that power in order to reflect their bias. I’m not saying that Roethlisberger actually committed a crime, or that he didn’t commit a crime. Yet we cannot say that what Roethlisberger engaged in was simply a violation of the generally accepted morals of American society either. Even if seen in the most optimistic light, Roethlisberger brought significant embarrassment to himself, his team and teammates and the NFL. An executive at a Fortune 500 company could no more get away with going on a bender and attempting to have sex in a public bathroom — an incident that somehow becomes public — than Roethlisberger could. So for Wilbon or anyone else to rally around the “can’t legislate morality” flag is somewhere between idiotic and shameful.

The issue with Roethlisberger isn’t that the NFL’s engaged in legislating morality. Nor is it that the district attorney in Georgia wanted to bring a case to trial but couldn’t because of insufficient evidence. The real issue here is that we as a society have made a thick distinction between what is and isn’t moral behavior and what is and isn’t criminal behavior, because they aren’t mutually exclusive. For progressives and libertarians, the distinction is whether one’s behavior is detrimental to the health and lives of other people. Black civil rights, gay rights, and smoking weed are among the things that most would assume would not harm the lives of other citizens, at least in 2010. Having an encounter in a bathroom that leads to another person going to the hospital with bruising and bleeding, however minor, is detrimental to that other person.

In light of this being Sexual Assault Awareness and Prevention Month, maybe folks like Wilbon should be more careful when choosing words like “can’t legislate morality.” Not only do we legislate morality, societies will engage in this kind of activity as long as there is such a thing as a society. So I ask that everyone with a microphone and a camera pointed at them to stop talking about legislating morality as if moral values are as set in stone as the Earth orbiting the Sun. You’re merely reflecting your own bias, against women, gays, Blacks, drugs, science. Or in Wilbon’s case, a need to stay out of the judgment fray that moves us from one scandal to the next, a need to get to the day when Roethlisberger throws three, four or five touchdown passes in a game. On that part I fully agree. But say that, Wilbon, because that’s what you’re good at. Don’t say you can’t legislate morality, because last I checked, this isn’t your area of journalistic expertise.
